The World Trade Organization (WTO) dispute settlementsystem can be viewed as a major achievement of the1986 Uruguay Round. Especially in the ongoing disputesettlement understanding (DSU) review, WTO membercountries have raised many issues, suggestions, andrequests that promise to further improve thefunctioning of the dispute settlement system. Many ofthe proposals under review concern either differentkinds of remedies that can be awarded as a responseto a violation, or the access of member countries tothe dispute settlement process.From the proposals that have been submitted over theyears, two requests stand out and deserve particularattention since their potential effects are complexand unexplored: Mexico's proposal in 2002 that WTOretaliation rights should be made tradable, and therequest for increased third party participation indisputes. This book examines these two issues indetail and provides answers on whether and how theright to retaliate can be made tradable, and how theparticipation of WTO member countries as thirdparties to a trade dispute can affect the likelihoodof settlement.
