Unwritten laws already existed at the time of traditional Malagasy society. It was a time when written language did not yet have its place, but it was a time when oral language took over. As a result, the majority of unwritten laws were heard and known through proverbs within society. Later on, when the society evolved, the administration took over the affairs of the state, and the judicial administration was part of it. It was here that the written laws governing society began. It should be noted that no man is above the law. So why does popular justice exist? This justice which is opposed to the laws of the State and which is against the principles of the Rule of Law of the country? For the continuation of the work, the following plan will be adopted: first, it will be necessary to see what is the unwritten laws and the Malagasy traditional society. Secondly, the written laws and the popular verdict in the contemporary Malagasy society.
