COLLECTIVE PROCEEDINGS AGAINST SMALL ENTERPRISES UNDER OHADA LAW

Collective proceedings against small enterprises are a set of legal rules applicable to small enterprises in difficulty in the Ohada space. These rules are still called simplified collective procedures. They are applicable when the small enterprise is in difficulty. It is a question of prevention of difficulties by detection or by simplified preventive settlement. Also, the procedure of simplified judicial recovery and simplified liquidation of property are not negligible. On the other hand, all these legal mechanisms provided for by the legislator have many dysfunctions. This can be seen in the system of prevention of difficulties and the curative system of these difficulties. This is why the desire for reform has been expressed. It is a question of improving the mechanisms of prevention of difficulties and the curative mechanisms of these difficulties. This in order to attract the maximum of investors in this economic space.
