The subject of the proposed study is social conflicts, which nowadays seek a quick, effective and safe solution. To this end, alternatives to the search for the Judiciary have emerged, including mediation. In view of the infinite number of lawsuits brought before the Judiciary, making it increasingly time-consuming to provide the desired judicial service, alternatives to judicial control of conflict resolution are viable and legally possible to put an end to situations in which the active participation of the court is not mandatory. With this need, the State, no longer acting as the State-Judge, but through alternative mechanisms, but still managed by the State, will, through numerous institutions, such as the WTO, CADE, and also the Preliminary Conciliation Commissions, seek solutions to the conflicts that arise.
