The book focuses on problems of Foreign DirectInvestment (FDI) in modern Ukraine. The main questionasked is: Has Ukraine managed to create attractivelegal environment for FDI? The analysis of thenational Ukrainian legal framework is made throughits comparison with the legislation of Germany. Theresults of the research show that the Ukrainianinvestment legislation is overloaded with definitionsand artificial restrictions for foreign investorswhich is an obstacle to achieve balance between thenational interests and the attractiveness of thecountry for FDI. As well, the comparative study ofthe two countries demonstrates the efficiency of theGerman investment promotion institution and thenecessity for Ukraine to reform existing nationalinvestment promotion institutions into a single one.The book contains recommendations as to thereforms of the Ukrainian dispute resolution systemwhich are necessary to convince potential foreigninvestors that in case of any dispute they can relyon the effective legal protection.

Autorentext

Born in 1980 in Makiivka, Ukraine. Received his law degrees from
Donetsk National University in 2003 (Specialist in Law), and
Central European University in 2007 (LL.M.). In 2000 - 2006 he
practiced commercial law in Ukraine. Currently he is an SJD
candidate at Central European University in Budapest.

legal environment for FDI? The analysis of the
national Ukrainian legal framework is made through
its comparison with the legislation of Germany. The
results of the research show that the Ukrainian
investment legislation is overloaded with definitions
and artificial restrictions for foreign investors
which is an obstacle to achieve balance between the
national interests and the attractiveness of the
country for FDI. As well, the comparative study of
the two countries demonstrates the efficiency of the
German investment promotion institution and the
necessity for Ukraine to reform existing national
investment promotion institutions into a single one.
The book contains recommendations as to the
reforms of the Ukrainian dispute resolution system
which are necessary to convince potential foreign
investors that in case of any dispute they can rely
on the effective legal protection.
