Functionalisation and expansion of criminal law:

The book deals with the expansion of criminal law and the use of the instrument of negotiated criminal law. The expansion of criminal law is presented as a consequence of the phenomenon of globalisation, the world political and economic order and the increased complexity of social relations. Despite the criticisms, the book reveals that the expansion of criminal law is inevitable. Likewise, the expansion of solutions brought about by negotiated criminal law, such as plea bargains and plea bargaining, are also dealt with in the book. With an emphasis on the legislative projects for new penal and criminal procedure codes, the approach taken in the article is relevant because it seeks to make these institutes compatible with the Brazilian constitutional order.
