This thesis analyses the regulation of emerging technologies, such as AI. It offers practical recommendations for policymakers navigating the intersection of technology, law, and society.

This thesis examines regulatory strategies for AI technologies. The first part illuminates the fundamentals of artificial intelligence from its historical development through technical functionalities to practical application fields. AI is understood as a multidisciplinary phenomenon characterised by a variety of technical approaches, lacking a uniform definition and finding application in nearly all areas of life. The second part addresses the risks of technological developments in general and specifically AI risks. The focus is on how law deals with these risks. A central problem is uncertainty regarding novel technology risks, which significantly complicates their quantifiability. The work analyses various classification approaches for AI risks and establishes concrete references to the AI Act. The third part analyses technology regulation in the EU, examining different regulatory approaches and methods, particularly in dealing with uncertainties. The work compares various regulatory modalities and again references the AI Act. The concluding part formulates concrete policy recommendations for legislators.

Lea hat Rechtswissenschaften an der Humboldt-Universität zu Berlin und der Sapienza Universitá di Roma studiert. Nach ihrem ersten Staatsexamen hat sie einen Masterstudiengang im Fach Law and Digital Technologies an der Universität Leiden absolviert. Während ihres Referendariats am Kammergericht hat sie in einer internationalen Großkanzlei in der Praxisgruppe Technologie, Medien und Telekommunikation gearbeitet und weitere Stationen im Grundsatzreferat Digitalisierung im Bundesinnenministerium und beim Digitalverband Bitkom absolviert. Nach Abschluss des zweiten Staatsexamens hat Lea promotionsbegleitend als wissenschaftliche Mitarbeiterin beim Digitalverband Bitkom gearbeitet und war außerdem als assoziierte Forscherin am Weizenbaum-Institut tätig.
