This book proposes and outlines a comprehensive framework for judicial protection in transnational criminal proceedings that ensures the right to judicial review without hampering the effective functioning of international cooperation in criminal matters. It examines a broad range of potential approaches in the context of selected national criminal justice systems, and offers a comparative analysis of EU Member States and non-Member States alike. The book particularly focuses on the differences between cooperation within the EU on the one hand and cooperation with third states on the other, and on the consequences of this distinction for the scope of judicial review.

Autorentext

Martin Böse is Professor at Bonn University and Acting Director of the Criminal Law Institute. His main research interests lie in the fields of European criminal law, international cooperation in criminal matters, and economic criminal law. He coordinated and participated in many international research projects (among others, on the establishment of a European Public Prosecutor's Office, the evaluation of mutual trust in the EU with regard to the implementation of the European Arrest Warrant, and on conflicts of jurisdiction in criminal matters in the EU).Anne Schneider is Professor at the University of Mannheim. Her main research interests lie in the fields of German criminal law and criminal procedure, European criminal law and criminal procedure and White collar crime. She has participated in several international research projects that analysed, for example, conflicts of jurisdiction in criminal matters in the EU, vertical cooperation with EU authorities such as OLAF and the implementation of the EU Directives on defence rights in national law.

Maria Bröcker is a research assistant and doctoral candidate at the Criminal Law Institute of Bonn University. Her main research interests lie in the fields of European criminal law and German constitutional law. For her thesis in the group of Martin Böse, she focuses on questions related to transnational criminal proceedings.
