Human life is full of pitfalls, some of them crucial. State life is no different. It is also shaken, sometimes so much so that salvation requires drastic and rigorous measures, detrimental to the interests of citizens. There is no doubt that these necessary measures apply only to such crises, and should not be enacted in normal times. Limitations on rights and freedoms thus differ between normal or ordinary legality and exceptional legality. But this is only true in a democracy.In law, the theory of legality and that of exceptional circumstances have evolved with the recent appearance of the coronavirus pandemic, whose harmful effects are no longer to be boasted. The D.R.C. has been confronted with this plague and has responded to it.The measures taken by the Congolese authorities to combat Covid-19, which have had an impact on freedom of movement and demonstration, have in most cases been illegal.
