Starting with a thorough analysis of the basic judgments of the European Court of Justice this book covers the whole development of the principle of member state liability as well as its implementation in the civil law jurisdiction Austria. Besides dealing with the key issues of interpreting the basic state liability principles special emphasis is put on the difficulties of integrating a case-law based liability system into the pre-existent framework of national procedural law.

This book is based on Jakob Halder's diploma thesis which he submitted at the University of Innsbruck in 2008. After having finished his studies in law and business administration Jakob Halder started working at a business law firm in Austria, where he is specializing on European law, in particular antitrust and state aid law.
