Post-legal defense of a threatened constitution

Beyond its institutional weaknesses, the real strength of the 91 Constitution, more than in the legal aspects to which liberal constitutionalism reduced it, resided in its social projection as a symbolic aspiration of an inclusive, guaranteeing and democratic nation that an authoritarian parochial-submissive culture persists in confronting and that can only be defended from a post-legal dimension that rescues and recovers its social and vital-world meaning.
