Protection of the employee against dismissal

The Gabonese State has created structures such as the National Employment Office to facilitate and supervise access to work for all. However, the role of the State cannot be limited to simply promoting full employment, as it is also required to control and regulate labour relations. Also, in a social context where unemployment, poverty and job insecurity prevail, the question of the protection of the employee against dismissal for personal reasons rightly challenges the legislator and the judge. Indeed, they are required to harmonize the working relationship between the employer and the employee on the one hand, and to preserve the interests of the employee on the other hand, in order to ensure social peace and the prosperity of companies. The dynamism of a company relies on the employees who work tirelessly for its prosperity. This is why, through the Labour Code, the Gabonese legislator protects workers against dismissal in order to repress abusive actions of company managers.
