Public law and the changing role of the state
Details
We have explored in depth the structural transformations of public law in relation to the changing role of the state, a crucial issue in the contemporary legal and political landscape. Our analysis revealed that the State, faced with unprecedented societal challenges, the forces of globalization and the growing influence of external law, has seen its prerogatives, modes of action and functioning redefined in significant ways. The results of our study corroborate the initial hypothesis that the State finds itself obliged to adapt, not only to meet the new expectations of citizens and the demands of multi-level governance, but also to align itself with the norms and obligations of international and supranational law. This adaptation can be seen in the emergence of new public management paradigms, in the redefinition of the boundaries between national and international law, and in the adoption of more flexible and collaborative regulatory mechanisms.
