Recent Trends in Increasing Efficiency in International Arbitration

In the past decades, international arbitration has become an extremely costly and at the same time, a rather lengthy method of resolving disputes. The issue of increasing efficiency has become a key prerequisite for maintaining and developing the system of international arbitration. This work deals with analysing methods of increasing the efficiency of international arbitration. It examines the individual factors that influence efficiency, it describes the typical problems that cause lengthy proceedings and increasing costs and it offers methods of eliminating these problems. The presented aspects are analysed chronologically according to the individual phases of the arbitrary proceedings. The author comes to the conclusion that the deciding factor influencing the efficiency of specific arbitrary proceedings is the arbitrator's level of activity. This implies an emphasis on case management and its individual methods. Attention is also paid to the specific process institutions, such as interim measures, default proceedings, summary disposition, anti-suit injunctions and fast-track procedures.
