Roach v Electoral Commissioner (2007) HCA 43 is a High Court of Australia case dealing with the validity of Commonwealth legislation that preventing prisoners from voting. Amendments made in 2006 that prevented all prisoners from voting were challenged, as was the previous legislation preventing all prisoners serving a sentence of 3 years or greater from voting. Two different versions of the legislation were challenged: the Electoral and Referendum Amendment (Enrolment Integrity and Other Measures) Act 2006 (Cth), which disenfranchised everybody serving a sentence of imprisonment, and the previous legislation, the Electoral and Referendum Amendment (Prisoner Voting and Other Measures) Act 2004 (Cth), which only disenfranchised those serving a sentence of 3 years or longer.
