Rousseau, Aristotle and the legal decision

Analysing ADI 3510, more specifically Justice Marco Aurélio's vote in the case, showed the impact of these two characteristics of rhetoric: the doubt that hung over the issue (which could not be readily answered in the legal sphere) could be circumvented using arguments from spheres other than the legal sphere, thus creating a decision that was not certain and absolute, but plausible. This is an exemplary case of the importance of rhetoric today, after the angry criticism it has received throughout history.
