Each people has its own culture, historically and materially determined, which is expressed by different values, structures, individualities and symbols. Given these peculiarities, the need arises for instruments that guarantee the preservation of each nation's culture. It is the state's responsibility to provide mechanisms and instruments that guarantee the protection of culture. However, within the logic and ideology of neoliberalism, companies are urged and live in pursuit of profit and this way of being seems to fit as the only possible way of acting. The state finds it difficult to fulfil its mission as a guarantor, since any investments that are not in line with market demands are immediately discarded. This leads to conflicts of interest between private companies and the collective interest.exclusively as an expense and not as an investment, a concept that is understood transcendentally, as a non-profitable return on the capital invested. Seeking to break with the previous military regime in Brazil, the 1988 Federal Constitution (CF/88) established a list of fundamental rights and guarantees.
