The African Heads of State and the International Criminal Justice

Most of the time cited at the heart of the greatest human rights violations and sometimes a key player in their resolution, the Head of State is increasingly, in Africa, the main target of multi-dimensional and multi-level judiciary actions. In this wake, the crucial question, therefore, arises relating to his necessary accountability which incidentally leads to the problem of the jurisdictional competence definition, relating thereto at the national, regional, continent, al and global levels. On the theoretical level, the dominant trend is in the era of the impunity end, due to the the immunity of the Head of State's status as a corollary of the nation state's sovereignty of which he fundamentally embodies the legal personification. This implies that from now on, in the event of serious tangible violations of human rights in his country, especially in times of war or in the post-conflict phase; the international community seeks to place the responsibilities on the incriminated Head of State. This is by the juxtaposition of the legal principles of the end of impunity as a matrix of the doxa of the theory of regimes in international relations.
