The legal provision for preventive detention in the Maria da Penha Law

Historically, women have suffered violence at the hands of their partners, a situation that has been neglected by society in general, since, in most cases, such acts of violence are not made public for a variety of reasons. Given the need to make these acts known to the State and society as a way of correcting these distortions, we are faced with the need to create serious mechanisms to combat this type of violence. With the creation of emergency protective measures, there is also a need to implement mechanisms to ensure their effectiveness. In this context, preventive detention is another suitable means of ensuring compliance with the protective measures instituted in favor of the victim, in order to reduce the incidence of violent acts occurring within marital homes and ensure respect for the law itself.
